The New York State Public Service Commission (DPS) is a major regulatory body for all services including telephone, water, natural gas and electricity.NYS Public Service Commission (DPS)
Effective May 1, 2014, a new capacity zone, proposed by the New York Independent System Operator (NYISO) and called the Lower Hudson Valley Capacity Zone (LHV), was approved by the Federal Energy Regulatory Commission (FERC). The creation of the LHV and the increased charges are a direct result of Order, Docket No. ER13-1380-000 issued by FERC. Lower Hudson Valley encompasses NYISO Load Zones G, H, I and J.Docket No. ER13-1380-000
The New York Independent System Operator (NYISO) is a not-for-profit corporation responsible for operating the state’s bulk electricity grid, administering New York’s competitive wholesale electricity markets, conducting comprehensive long-term planning for the state’s electric power system, and advancing the technological infrastructure of the electric system serving the Empire State. Please visit their website for more information: www.nyiso.com.NYISO Website
The Federal Energy Regulatory Commission (FERC) is the United States federal agency with jurisdiction over interstate electricity sales, wholesale electric rates, hydroelectric licensing, natural gas pricing, and oil pipeline rates. You can see the location of Zones G, H, I on this Map from the FERC website.FERC Map
If you are in NYISO Load Zones G, H, I, then you were previously in the “rest of state” (ROS) capacity zone. Pricing for capacity has increased much more than if you are in the NYISO Load Zone J. Load Zone J is in the New York City capacity zone, which had higher capacity prices before the LHV was created. As a result, if you are in NYISO Load Zones G, H, I and are currently on a fixed price contract with Just Energy, you should have received a notice informing you of the new rate that will be applied starting on the bill following the notice. If you are in NYISO Load Zone J, your fixed rate will not change. The change in your rate is solely based on the capacity cost change and we are passing it through to you at no markup. The capacity cost change is calculated based on the average change in cost for our active book of customers in Load Zones G, H, I who were priced based on the previous ROS capacity costs.
Capacity cost is paid to power generators to ensure that there’s enough power produced during “peak” hours. Those are the hours in the hottest days of the year. As electricity cannot be easily stored, generators need to be incented to build more power plants to meet demand, which drives up the capacity costs in areas where generation is scarce.
